Terms of Use

These terms are an agreement between you and Ektasi Technology (OPC) Private Limited (“Ektasi”, “we”, “us”), the company that makes OrdersTrail. By creating an account or using OrdersTrail, you agree to them. If you don't agree, please don't use the app.

1. What OrdersTrail is

OrdersTrail helps small businesses such as home bakers keep an order book. You can record orders and customers, track orders to delivery, price your products, see sales, get reminders about repeat occasions, and send updates through your own WhatsApp, phone or email.

2. Who can use it

You must be at least 18 and able to enter a binding contract. You use OrdersTrail for your own business. If you use it on behalf of a business, you confirm you're allowed to accept these terms for that business.

3. Your account

• You sign in with a code sent to your email address, or with a password if your account has one. Keep your email account secure, because anyone who can read it can sign in.
• Give accurate details and keep them up to date.
• Tell us straight away at support@ektasi.io if you think someone else has accessed your account.

4. Early access and fees

OrdersTrail is in early access. It's free to use during this period. We plan to introduce paid plans, currently expected to be ₹149 per month, and we'll tell you well in advance. You'll never be charged unless you choose a paid plan and agree to its price. Features may change, be added or be removed while we improve the app.

5. Your data and your responsibilities

• Your records are yours. You give us permission to store, process and display them only to provide OrdersTrail to you. You can export them at any time.
• Your customers' information. You decide what to record about your customers and suppliers. Record only what you need, keep it accurate, and make sure you're allowed to keep it and to contact those people, including under the Digital Personal Data Protection Act, 2023.
• Messages you send. Messages go out from your own WhatsApp, phone or email. You're responsible for them and for following WhatsApp's terms. Don't send spam or unwanted marketing.
• Keep your own copy. We work hard to keep your data safe, but please export important records regularly.

6. Acceptable use

Don't use OrdersTrail to:

• break any law, or store content that is unlawful, harmful, or infringes someone else's rights;
• harass, deceive or spam anyone;
• try to access other users' data, or probe, overload or disrupt our systems;
• copy, resell or reverse-engineer the service, except where the law allows it or an open-source licence for a component permits it.

We may suspend or close accounts that break these rules, and we'll explain why unless the law prevents us.

7. Our app and content

OrdersTrail, including its design, code, name and logo, belongs to Ektasi or its licensors. We give you a personal, non-exclusive, non-transferable licence to use the app for your business while these terms apply. Open-source components are covered by their own licences, listed in the app under Settings → Open-source licences.

8. Other services

OrdersTrail relies on services run by others, including Supabase (database and sign-in), Google (fonts, and Google Play if you install from there), GitHub (website hosting) and WhatsApp (messages you choose to send). Their own terms apply to your use of them, and we're not responsible for their availability or conduct.

9. Suggestions, not advice

Price suggestions, profit figures and reminders are there to help you decide, based on the numbers you enter. They're not financial, tax or legal advice. The decisions about what to charge and whom to contact are yours.

10. Availability and warranty

We aim to keep OrdersTrail running smoothly but can't promise it will always be available or error-free, especially during early access. To the extent the law allows, the service is provided “as is”, without warranties of any kind.

11. Limitation of liability

To the extent the law allows, Ektasi isn't liable for indirect or consequential losses such as lost profits, lost business or lost data. Our total liability for any claim relating to OrdersTrail is limited to the amount you paid us for the service in the 12 months before the claim, or ₹1,000 if you haven't paid anything. Nothing in these terms limits liability that can't be limited under Indian law.

12. Ending the agreement

You can stop using OrdersTrail at any time and ask us to delete your account (see Delete your account). We may end or suspend the service with reasonable notice. If we ever shut OrdersTrail down, we'll give you time to export your data first.

13. Changes to these terms

We may update these terms. We'll change the date above, and for significant changes we'll tell you in the app or by email before they apply. If you keep using OrdersTrail after that, the new terms apply.

14. Law and disputes

These terms are governed by the laws of India. Please contact us first so we can try to resolve any problem. If that doesn't work, the courts at Varanasi, Uttar Pradesh have jurisdiction.
